The Government created the National Entity for Control and Management of the Navigable Waterway, which will have the mission of ensuring the quality and adequate provision of the services of the Paraguay-Paraná waterway, the proper protection of users, the safeguarding of public and private property of the State and compliance with the laws.
He did it through the Decree 556 / 2021 published today (25.08.2021/XNUMX/XNUMX) in the Official Gazette which determined that eThe Entity will act as a decentralized body with administrative, functional and economic-financial autonomy within the scope of the Ministry of Transport., with its own legal personality and capacity to act in the field of public and private law.
It will be based in the city of Rosario., in the province of Santa Fe, and It will oversee compliance with the regulations and contractual and regulatory frameworks through auditing, control, inspection, regulation and monitoring of administrative, primary environmental, economic-financial, legal, determination and modification of layout, tariff and technical matters of public works concession contracts.
It will also control other contracts that may be carried out for the development of modernization, expansion, operation and maintenance works of the signaling and beaconing system, dredging and redredging, hydrological control or activities complementary to those, between kilometer 1.238 of the Paraná River, a point called Confluencia, up to the Natural Deep Water Zone, in the outer Río De La Plata.
The management of the Entity will be in the hands of a Board of Directors made up of 15 members, who will be "ad honorem" and will be appointed by the Executive Branch.
The president will be appointed by the President of the Nation; the first vice president and two members will be proposed by the Ministry of Transport; the second vice president and one member will be from the Ministry of the Interior; the third vice president and one member will be from Productive Development; and seven members will be proposed by each of the provinces that signed the Federal Hydroway Agreement.
On the other hand, the rates and tolls that are set based on concessions granted on the Waterway will be collected by the Entity on behalf of and by order of the concessionaire or concessionaires and remitted to him or them, after deduction of the corresponding amounts.
