The National Government implemented new measures based on international standards as a means of facilitating trade.
Indeed, the Ministry of Economy approved the new Technical Regulation that establishes the essential quality and safety requirements and characteristics that construction materials sold in Argentina must meet.
The measure was formalized this Friday (30.08.20234) through the Official Gazette, under the Resolution 236/2024.
Scope
The requirement of the standard covers the products reported in its Annex II (steel products, wires and cords, sheets, among others) which will have to meet the necessary requirements for environmental protection, through to personal safety and national security, up to information (Annex I), typical of a foreseeable commercial environment.
Therefore, the national manufacturers and importers must meet such requirements.
Meanwhile, distributors and marketers, whether wholesalers or retailers, must require their suppliers to comply with the required requirements. To this end, it is necessary to have a simple copy of the Declaration of Conformity, in paper or digital format, to be displayed when required.
Regarding complementary rules, modifications or clarifications, the resolution empowers the National Directorate of Technical Regulations of the Secretariat of Industry of the Ministry of Economy at its request, to make the provisions operative.
Implementación
The obligations established with respect to the construction materials in Annex II will be enforceable from the following dates:

Sanctions
Violations of the provisions of this measure will be subject to the sanctions provided for by the Law No. 24.240 and its amendments and the Decree No. 274 dated April 22, 2019, without prejudice to any criminal, civil or administrative liability that may arise, in accordance with the provisions of Article 110 of the Administrative Procedures Regulations, Decree No. 1.759/72 – TO 2017.
clarifications
Compliance with the obligations described does not exempt the affected parties from compliance with the obligations arising from other regulations that apply to the products contemplated herein.
Repealed regulations

Transitory dispositions
Certificates issued under the Technical Regulations repealed by Article 9 of this standard, with respect to the products listed in Annex IV, will remain valid for the following period: period of up to twelve (12) months after the implementation date established in the aforementioned Annex IV, and the planned surveillance must be carried out, where appropriate.
Once the aforementioned period has ended, manufacturers and importers of the products affected must, where appropriate, make the necessary adjustments to comply with this measure.
Certification bodies and testing laboratories that are currently recognized to act within the framework of the Technical Regulations referred to in the preceding paragraph will maintain their status to act in application of this measure with the scope they currently hold, and must make the necessary adjustments to apply in the new schemes provided, in accordance with what is established in due course.
The testing laboratory for plywood panels of the National Institute of Industrial Technology (INTI) will maintain its status as recognized to act in this resolution for the Plywood Panel products during the period of twelve (12) months from the entry into force of this measure.
During the period of coexistence of the Regulations listed in Annex V and this Resolution, it will be considered that the national manufacturers and importers of the products covered by said measure guarantee compliance in accordance with the law, if they prove the requirements established by one of the two (2) Regimes.
The materials for electrical installations listed in point 169 of Annex II of this measure are excluded from the scope of Resolution No. 27 dated March 2018, 4 of the former Ministry of Commerce (Former Mins. Prod.).
Validity
This Resolution will come into force from the day August 31th, 2024.
