New provisions for cargo scanning at the Port of Montevideo

The National Customs Directorate, through General Resolution 56/2024, announced this Friday (20/09/2024) new provisions for cargo scanning at the Port of Montevideo, in order to "strengthen controls on customs operations."

These measures "will come into force on October 2, 2024, subject to obtaining and publishing the operating license for the installed X-ray equipment, which must be issued by the National Regulatory Authority for Radiation Protection of the Ministry of Industry, Energy and Mining," the publication states.

The regulations explain that such measures are based on the Article 46 of Law 19.276 (Uruguayan Customs Code), which establishes that the control, surveillance and inspection of merchandise, means of transport and cargo units will be the responsibility of the National Customs Directorate. This control also extends to merchandise that crosses the customs territory towards the exterior, based on risk analysis. The law grants the National Customs Directorate the authority to dictate the norms and procedures necessary to apply customs legislation.

Additionally, the publication indicates that these guidelines for strengthening customs controls were presented in consultation with various entities, such as the Uruguay Navigation Center, the Uruguayan Customs Brokers Association, the Uruguayan Chamber of International Land Transport, the Uruguayan Inter-Union of Professional Land Cargo Transport, the Uruguayan Chamber of Industries, the Uruguayan Chamber of Commerce and Services, the Chamber of Commerce of Products of the Country, the Uruguayan Chamber of Free Trade Zones, the Uruguayan Union of Exporters and the scanning service provider. Following the analysis, these institutions provided their observations.

In view of all the above, Customs resolved that "the scanning of cargo under its control will be subject to the provisions of this General Resolution and to the intra-port circulation provisions communicated by the National Port Administration."
