Following a complaint from the Federal Public Revenue Administration (AFIP), the courts have prosecuted businessman Nicolás Paladini, president of Biocom SA, for the alleged crime of improper use of taxes.
In addition, the court imposed a seizure of $1.000.000 and a general restriction on his assets.
The case was initiated following a complaint filed by the AFIP against the company BioCom. SA for having improperly received $1.800.000 in export refunds, through the presentation of false invoices for alleged operations with also false suppliers.
According to the complaint, the company operated through a group of companies and individuals who acted in the grain market as producers and sellers of cereal, so that the accused firm could compute tax credit in its favor in its tax returns.
Following the investigation carried out by the AFIP in recent years, it was concluded that these firms did not have the operational capacity to carry out these operations, nor registered personnel in an employment relationship, nor assets in use in their name.
Federal Court No. 3 of Rosario, headed by Judge Dr. Carlos Vera Barros, prosecuted Nicolás Paladini, after the Federal Court of Appeals revoked the lack of merit ordered in the first instance by the same court.
The crime of improper use of taxes carries a prison sentence of two to six years.
