The National Executive Branch published this Thursday (26.03.2022/XNUMX/XNUMX) the law that granted a regulatory framework to the production of medicinal cannabis and industrial hemp, in order to encourage productive activity, employment and exports in the sector.
This is how the Decree 266 / 2022 in the latest update of the Official Gazette, with the signature of the president, Alberto Fernández, the Chief of Staff, Juan Manzur and the Minister of Productive Development, Matías Kulfas.
The objective of the regulation is to provide a legal framework for public and private investment throughout the medicinal cannabis chain and to complement the current legislation, Law 27.350, which authorizes the therapeutic use of cannabis.
The enacted legislation also creates the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (ARICCAME), which will operate within the Ministry of Productive Development and will be responsible for approving and administering licenses for the industrial production of the crop.
The decentralized public body will have the function of regulating the import, export, cultivation, industrial production, manufacturing, marketing and acquisition, by any title, of seeds of the cannabis plant, cannabis and its derived products for medicinal or industrial purposes.
The Medicinal Cannabis and Industrial Hemp Law must be regulated by the Executive within a period of one hundred and eighty (180) calendar days from its recent publication in the Official Gazette.
