The national government has made official the application of VAT to popular systems such as Netflix or Spotify, by ordering that this tax apply to all legal streaming and download services for films, series, music and games.
Through the decree 354 / 2018 published on Tuesday (24.4.2018) was regulated the collection of VAT on digital services when they are provided by foreign entities.
La The measure will be applied from Wednesday, April 25, 2018, details the norm signed by President Mauricio Macri; the Chief of Staff, Marcos Peña; and the Minister of Finance, Nicolás Dujovne.
El VAT will be borne by the consumer andIf there is an intermediary involved in the payment, he/she will act as a collection and settlement agent.
"If an intermediary resident or domiciled in the country intervenes in the payment, he will act as a collection and settlement agent. The AFIP will determine the form and deadlines in which the collection of the tax must be carried out and entered," according to the official text.
Meanwhile,Credit card issuers will be responsible for withholding VAT and depositing it with the AFIP.
Foreign currency transactions will be converted at the selling exchange rate of Banco Nación, "at the close of the day prior to the day on which the taxable event is perfected," the law stated.
