After Spanish President Pedro Sánchez’s announcement, the Argentine Government has officially dissolved the Federal Administration of Public Revenues (AFIP), an autonomous entity that operated under the jurisdiction of the Ministry of Economy, through the Decree 953/2024.
Through this regulation, published today (25.10.2024), the Customs Rehabilitation and Control Agency (ARCA) as an autonomous entity within the scope of the same ministry. This transformation seeks to optimize the management of public revenues and strengthen customs control in the country.
The measure aims to streamline the application and oversight of the tax, customs and social security regime. In its comments, the decree points out that the old agency has grown disproportionately in its organizational structure, which has limited its capacity to respond quickly and effectively to the demands of the system, thus affecting the administration of public resources and the control of customs activities.
The new one is expected The Customs Regulation and Control Agency (ARCA), with a simplified structure, optimizes its operations, ensuring greater specialization and efficiency in the execution of its functions. The aim is to improve the quality and speed of services provided to citizens, since the breadth of responsibilities assigned to the body that is proposed to be dissolved has led to a dispersion of resources and an imbalance in the attention to its various areas of competence.
The new entity to be created will allow for a more rational use of human and material resources, strengthening the State's capacity to respond to the social and regulatory demands corresponding to each area.
Designations
According to the decree, the Customs Regulation and Control Agency (ARCA) will be headed by an Executive Director, appointed by the National Executive Branch. This Director will be accompanied by a General Director responsible for the General Tax Directorate and another General Director in charge of the General Customs Directorate. There will also be Deputy General Directors, whose number and powers will be determined by the National Executive Branch.
To this end, the President of the Nation has appointed, through the Decree 954 / 2024, to the lawyer Florencia Misrahi as Director of ARCA, to the graduate Andrés Vázquez , the Director of the General Tax Directorate from ARCA and to the Lord José Andrés Veliz , the Director General of the General Directorate of Customs from ARK.
The appointed Executive Director must now submit (within 60 days) her proposal on the rules relating to the powers, faculties, rights and obligations of the new ARCA, as well as its organizational and functional structure.
The measure takes immediate effect.
