The Government determined that the National Commission for Foreign Trade will have the authority to analyze, investigate and regulate in determining material damage to national production in the situations provided for in Argentina's international trade legislation, through the 381 / 2019 resolution.
The measure, published in the Official Gazette this Friday (31.05.3019/XNUMX/XNUMX), establishes that "assigns to the National Foreign Trade Commission, a decentralized body within the jurisdiction of the Foreign Trade Secretariat of the Ministry of Production and Labor, the power to determine the possible existence of unfair commercial competition and, where appropriate, calculate its magnitude, conducting the instruction of the procedure and issuing the corresponding determinations, in accordance with the procedural deadlines in force in each investigation, as well as the power to issue the report provided for in article 10, section b) of Decree No. 1059 of September 19, 1996, regarding safeguards investigations, in accordance with the procedural deadlines in force in each investigation."
Furthermore, the official text clarifies that "Once the interventions provided for in the preceding article have been carried out, the proceedings must be sent to the Foreign Trade Secretariat of the Ministry of Production and Labor for further processing.".
The resolution will enter into force on June 3, 2019.
