New control system for warehouses, ships and barges for grain export

El National Service of Health and Food Quality (Senasa), approved by its Resolution 708 / 2022, published this Friday (04.11.2022) in the Official Gazette, the “System for controlling the capacity of cargo holds and tanks of ships and barges for the export of grains, their products and by-products”, whose implementing authority is the national health agency.

The new regulations are the result of joint work between the public and private sectors reflected in the final text of the aforementioned resolution.

With the aim of strengthening the development of the organization's tasks related to the control of health and safety of these products, a public consultation procedure was carried out, through which the project in question was duly informed through its official website for 15 days, from July 29 to August 13 and where the sector involved was able to make the necessary contributions to put this new system into operation.

In the same direction, Senasa authorities organized a series of meetings with the sector's chambers to seek the necessary consensus and incorporate contributions for an improvement in the implementation of the new system..

It is worth noting that the Control System It is applicable in river and sea ports, outer harbours, waiting areas, docks, harbours or any other place considered suitable for verification of the expected conditions.

In addition, the regulations approve the “Regulation of the Certifying Entities of the Loading Suitability Control System of holds and tanks of ships and barges for the export of grains, their products and by-products, for International Trade” and the “Regulation of the activities of accredited warehouse/tank verifiers”.

It also approves the “Supervision Procedure of the Loading Suitability Control System for the Holds and Tanks of Ships and Barges for the Export of Grains, Their Products and By-Products”, the “Ship Selection Procedure”, and the Inspection and Supervision Reports for Holds/Tanks.

Likewise, the regulations establishes the mandatory registration of all certifying entities in the Registry of Integrity and Transparency for Companies and Entities (RITE) of the Anti-Corruption Office, starting April 1, 2023, in order to operate under the terms of the new regulation.

Finally, it is highlighted that Creation of the Public-Private Coordination Working Group for Monitoring the implementation of this measure, which will operate within the scope of the Senasa Presidential Unit and empowers the national directorates of Agri-Food Safety and Quality and Operations to issue the necessary clarifying regulations.

Offenders who do not comply with the new control system are subject, as of April 1, 2023, to sanctions under the “Supervision Procedure of the Control System for the Loading Capacity of Holds and Tanks of Ships and Barges for the Export of Grains, Their Products and By-Products”, as well as the “Ship Selection Procedure”.

The regulations will come into force on the day following their publication in the Official Gazette, that is, on November 5, 2022.
