The Government enacted a law prohibiting the import of cosmetics and toothpastes with microbeads

The national government has enacted a law banning the import of cosmetic and oral hygiene products for dental use that contain intentionally added plastic microbeads.

La Law 27602, published today (29.12.2020) in the Official Gazette, prohibits "lthe production, import and marketing of cosmetic products and oral hygiene products for dental use containing intentionally added plastic microbeads, "from two years after the publication of this law."

The regulations include cosmetic products for personal hygiene and perfumes, toothpastes, gels and creams, mouthwashes and mouth rinses intended to clean, protect or maintain the oral cavity, soft and hard tissues in good condition.

The text defines as Plastic microbeads or microspheres are synthetic materials made from petroleum-derived or bio-based polymers, which are solid particles, less than five millimetres in size, which are not soluble in water and have low degradability.

Violations of this law will be considered serious or very serious, and will be sanctioned in accordance with the provisions of Law 16.463 on medicines and its regulatory standards. The National Administration of Medicines, Food and Medical Technology (ANMAT) or the agency that replaces it in the future is designated as the enforcement authority.
