Government opens investigation into alleged dumping in imports from China

The Government authorized the opening of an investigation for alleged "dumping" in the import of Expandable Polystyrene Granules originating from China and Chinese Taipei, included in tariff items of the Common Nomenclature of Mercosur.

According to Resolution 72 / 2020 published this Tuesday (26.05.2020) in the Official Gazette, the National Commission for Foreign Trade initiated a file, concluding that "according to the above and based on the information provided by the petitioning firm, and in accordance with the technical analysis carried out, there would be evidence that suggests the existence of alleged dumping practices for the export to the Argentine Republic of 'expandable polystyrene in granules', originating in the Republic of China and Taipei."

The investigation was requested by the company Styropek SA , a claim that was considered admissible by the Undersecretariat of Commercial Policy and Management of the Ministry of Productive Development.

The resolution explained that the National Commission for Foreign Trade "understands that it is likely that the lower prices of imported products, result in a increased demand for imports "request object".

The Commission considered that "the increase in imports subject to the request recorded in the last year of the period analysed, under conditions of large price undercutting, allows us to consider that it is likely that this trend will continue, and that the evidence relating to the high productive and export capacity of the country involved in the request, configures a situation of threat of significant damage to the national production branch.

In this regard, “…there is sufficient evidence to support the allegations of threat of significant damage to the domestic EPS industry, as well as its causal relationship with imports with alleged dumping originating in China and Taipei” and that “…consequently, it considers that the requirements demanded by current legislation have been met to order the initiation of an investigation,” the agency warned.
