Cristóbal López confirmed indictment for withholding contributions

In the case initiated by the Federal Public Revenue Administration (AFIP), Chamber A of the The National Chamber of Economic Crimes confirmed the indictments issued to Cristóbal Manuel López, Carlos Fabián De Sousa, Inversora M&S SA and OIL M&S SA, as perpetrators of the crime of misappropriation of taxes and social security resources, and the seizure of the sums of $30.000.000 and $250.000.000 respectively.

On the other hand, the Court revoked the partial dismissal that had been ordered for those cases in which the amounts improperly appropriated, depending on whether it was the social security or tax, were considered separately within the same month and thus the amount established by the tax criminal law as constituting a crime was not exceeded.

In this regard, he explained, following the criteria of the agency, that it is irrelevant whether the withholdings or collections had been made due to tax obligations of various kinds as long as they had occurred within the course of a month.

Furthermore, the The Court confirmed the prosecution of Mariano Luis Frutos, Cristóbal Manuel López, Carlos Fabián de Sousa and the firm Telepiu SA (C5N) as authors of the aforementioned crime and the seizure of the sums of $23.000.000 in respect of the first of them and $25.000.000 in relation to the rest.

It should be remembered that we are faced with a case with a broad procedural scope, in which more than 30 companies of the so-called “Indalo Group” are being investigated for approximately 1300 facts similar to those analyzed in these sentences. Regarding them, the first instance judge Dr. Maria Veronica Straccia has begun to set investigative hearings for the first days of December, among others for the companies Votions, Imagen Radial, DH Com, Radio Productora 2000, IGD, La Salamandra, Paraná Metal, Editorial Los Álamos, Cercuru and those responsible Lopez, De Sousa, Frutos, Zamora.
