New legislation that provides for less bureaucracy in foreign trade has been in effect since Tuesday (01.12.2020) in Brazil, the Brazilian Federal Revenue Secretariat (Receita Federal) reported.

“As of December 1, the RFB Regulatory Instruction No. 1984/2020, which deals with the qualification of property declarants to work in foreign trade, as well as the rules for the accreditation of officials and representatives in the agency's computer systems," the statement said.

The initiative aims to reduce bureaucracy and facilitate the flow of goods; the rating is awarded, as a rule, automatically, through the system ENABLES, located on the Single Foreign Trade Portal, and individuals are exempt from qualification.

Another significant change is the Extension of the automatic inactivity disqualification period, which went from 6 to 12 monthsIf deactivation occurs, the interested party can request activation automatically through the HABILITA system.

The Brazilian agency noted that the regulations “also It collects the legislation scattered in scattered acts and organizes it in a simpler way, clearly defining the roles that correspond to the declarants, the persons responsible who act on their behalf before the Federal Treasury and authorized representatives.”

Likewise, The Express, Limited or Unlimited rating system was maintained, according to the characteristics of the companies that require the rating and their financial capacity. If the person responsible wishes to increase the limit of their rating, they can make the request automatically through the HABILITA system, or open a Digital Service Dossier, in cases where it is necessary to include documents that prove their financial capacity if the system cannot automatically access them.

"The measure seeks to streamline the process and bring simplification to the foreign trade user, but without giving up customs control and combating fraud. The new Regulatory Instruction is inserted in a context of customs control that It contemplates the comprehensive management of foreign trade risks, reaching the pre-dispatch phases, the dispatch itself and subsequent operations and providing rules for better management of specific situations," the statement said.
