The National Government formalized the 27319 law de Investigation, Prevention and Fight against complex crimes through its publication in the Official Gazette this Tuesday (22.11.2016).
The same "has for object to provide to the police forces y of security, Public Prosecutor's Office and Judiciary the tools and faculties necessary to be applied to research, prevention and fight against complex crimes, regulating the figures of the undercover agent, the revealing agent, the informant, controlled delivery and extension of jurisdiction.
According to the law, "its application must be governed by principles of necessity, reasonableness y proportionality", since it is "a matter of public order and complementary to the provisions of the Criminal Code of the Nation."
It incorporates the figures of «undercover agent", the police with hidden identities who infiltrate criminal organizations in order to identify, stop or prevent a crime; the"disclosing agent» is a member of the security forces who simulates interest in transporting, purchasing or consuming goods, weapons or drugs, or in other criminal activity, in order to identify those involved and arrest them.
Other figures regulated by law are "informant"a civilian with a reserved identity who, in exchange for a financial benefit, provides information about criminal activity to the police or the courts;"the monitored deliverya» and «extension of jurisdiction"to authorize the judge to postpone the arrest of persons if he considers that it may serve the investigation.
The law is signed by the president of the Chamber of Deputies Emilio Monzó, the provisional president of the Senate Federico Pinedo and the parliamentary secretaries Eugenio Inchausti and Juan P. Tunessi.
