The requirements and demands requested for the registration of ISTA providers are adapted

The Federal Public Revenue Administration (AFIP) adjusted the demands and requirements requested for registration of providers ISTA and for the registration of devices PEMA, through the General Resolution 5451/2023.

The rule, published on Tuesday (05.12.2023), establishes the “Customs Transit Security Initiative (ISTA)” and provides for the implementation of a control mechanism for land transit operations for the import of goods throughout the territory of the Argentine Republic. This security initiative includes the joint and coordinated use of AFIP registration and control systems, as well as the technological platform for satellite tracking of transport units. In this way, it is possible to know in real time the traceability of land transits and the contingencies that occur during the course of operations, adopting the necessary measures to safeguard the functions assigned to the customs service.

The operation is carried out through a non-intrusive control mechanism that allows real-time monitoring of the cargo and any new developments that arise during the course of operations through the placement of the Electronic Customs Monitoring Seal (PEMA).

In order to guarantee the improvement in the service and the coverage of all the transit operations and transfers of monitored goods, as well as the quality of the information received, a sanctioning framework for possible non-compliance that ISTA providers could commit.

In order to be responsible for the levies and penalties that may be applicable in the event of non-compliance with the Monitored Customs Transit of Importation (TRAM) operations, the following must be taken into account:

• the vehicles of the transport companies affected by said operation are constituted of full rights as a guarantee.
• ISTA providers must constitute guarantees of action to the satisfaction of this Federal Administration.
• In the event of any incident, it will be carried out in First instance the guarantee to the ISTA provider. When such action is impossible, the execution will proceed against the carrier.

In the event of non-compliance being detected, depending on its type and severity, the following will be carried out: Comprehensive revalidation of the ISTA providerThis revalidation may include the technical approval of the PEMA, the systems and the services offered by the ISTA Providers.

PEMA and ISTA providers subject to revalidation may be disqualified until they receive final approval from the General Subdirectorate of Customs Control.
