WTO creates panel to resolve trade dispute between Argentina and the US over steel pipes

The World Trade Organization (WTO) agreed on Monday (19.09.2023/XNUMX/XNUMX) to form an arbitration panel to resolve the dispute between Argentina and the United States over the antidumping measures imposed by the second country against pipes used in the oil industry (OCTG, in English).

The Geneva-based organization's Dispute Resolution Body decided to form this panel at Argentina's request, after the United States blocked the first request at the meeting on August 30.

Argentina maintains that the application of anti-dumping duties was imposed by the United States in November of 2022, and that the contested measure entails “enormous economic damage.” In this regard, the country requested consultations with the United States on the matter on May 17, but said that the talks that took place on July 6 failed to resolve the matter, which prompted its request for the establishment of a panel.

At the same time, United States He said the anti-dumping duties were imposed on oil pipes from Argentina following an exhaustive investigation by the U.S. Department of Commerce and an equally exhaustive injury analysis by the U.S. International Trade Commission, which were entirely compatible with OM standardsC. For these reasons, the Northern country said that it could not accept the establishment of a special group.

The dispute settlement process before the WTO begins with a request for bilateral consultations, which always lead to a resolution panel by third parties if an agreement cannot be negotiated.

The final authority to rule should the WTO take part in the dispute would be the Appellate Body, the body's final authority, but it has been paralyzed for six years by the United States' refusal to approve the appointment of new judges to its ranks.WTO Note)
