The National Digital Certification System for Fishing Catches and Exports is made official

Through Provision 186/2022, published today (29.07.2022) in the Official Gazette, the Government made official the National System of Digital Certification of Fishing Catches and Exports. The measure will come into effect five calendar days after this public communication.

The decision of the Ministry of Agriculture, Livestock and Fisheries aims to  simplify the procedures before the National Public Administration and achieve speed in the generation of the Black Hake Capture Document, the Black Hake Export and/or Re-export Document and the Legal Capture Certificate of the Argentine Republic, which will also be used to be presented to the Administrative Authority of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES).

According to the regulations, the digital system will be managed by the National Directorate of Fisheries Coordination and Inspection of the aforementioned portfolio.

In addition, the possibility of preferentially processing the Certificate of Legal Capture of the Argentine Republic will be implemented for Exports that are marketed by air or land or who must submit the certification application before the official date of the boarding permit, with a express procedure which can be issued within 3 business days.

Regarding the legal background of the system, the regulations explained in the recitals that in 2008 through the  Litigation, Arbitration 1/2008 The Federal Fisheries Council approved the National Action Plan to prevent, discourage and eliminate Illegal, Unreported and Unregulated Fishing (PAN-IUU), within the framework of the International Action Plan adopted by the Fisheries Committee of the Food and Agriculture Organization of the United Nations.

He added that, through the Provision 8/2009 The National Certification System for Legal Capture of the Argentine Republic was created by the Undersecretariat of Fisheries and Aquaculture, which aims to certify all fishing resources, products or by-products that are captured in jurisdictional waters of the country for national and international trade. In this, all the information was collected digitally but the certificate(s) were issued in paper format, which forced the Administrators to assume additional charges such as logistics, delays, penalties, among others.

Thus, the new measure responds to the State Modernization Plan ofDecree 434/2016 aimed at moving towards a paperless administration, where systems from different organizations interact autonomously.
