OECD urges Chile to reform sanctions in cases of transnational corruption

The Organisation for Economic Co-operation and Development (OECD) on Wednesday (25.10.20179) urged Chile to reform its system of criminal sanctions in order to better combat transnational corruption.

Chile, which ratified the OECD Anti-Bribery Convention in 2001, "must make further progress in implementing the main recommendations made" by the organization, the latter said in a statement.

The OECD defines transnational corruption as companies "promising or paying bribes to a foreign public official in order to obtain advantages in the context of an international business transaction, such as the award of a construction contract or an oil concession."

The organization's working group welcomed the fact that its recommendations on criminal sanctions and bank secrecy are being studied in Chile, but encouraged the country to make these reforms a priority.

"Chile must carry out its legislative reform project to apply the same ceiling of economic sanctions to cases of national and transnational corruption; eliminate mandatory reductions in sanctions provided for in certain cases; and allow the collection of sums equivalent to the proceeds of acts of transnational corruption.l", asked the OECD.

The international organization also criticized the South American country for not having defined guidelines to create an "effective model" for preventing international corruption.

And it is She expressed concern about the conditional nature of the application of bank secrecy in cases of transnational corruption and the limited use of infiltration techniques in investigations into these crimes.

According to the OECD, Chile has not yet closed the persistent gaps in its anti-corruption measures and must therefore submit its reports to the organization's working group more frequently.

The next evaluation of the latter will take place in December 2018.
