The Federal Public Revenue Administration (AFIP), together with the Government of Tierra del Fuego, established an information exchange procedure for speed up the release of customs operations guarantees linked to the accreditation of origin of the Special Customs Area.
This is established by the General Resolution 5045-E/2021, published this Monday (09.08.2021) in the Official Gazette, whose text incorporates the consultation on information associated with the digital origin accreditation process (ODA). For this measure, the text indicates that a target is set maximum term of 90 days (from the entry into force of this regulation) for its implementation and operation.
It is worth mentioning that the Isla Grande de Tierra del Fuego constitutes a Special Customs Territory, established by Law 19.640. Therefore, it provides for a differentiated regime, both in economic and tax prohibitions with respect to the General Customs Territory. In this framework, the importance of the regulations on the origin of goods from the special customs area is highlighted.
Resolution 4712/1980, together with its amendments, established a procedure for the proper accreditation of origin of products manufactured in the special customs territory. The responsibility for issuing accreditations and certifications of origin for these goods lies with the Ministry of Production and Environment of the Province of Tierra del Fuego.
In cases where it is necessary to establish a guarantee to safeguard compliance with the obligations arising from the accreditation of origin of products from the special area affected by customs operations, they must be completed in accordance with the terms of article 453 of the Customs Code and under the mechanisms and procedures regulated by General Resolution 3885/2016.
Although this last resolution with its amendments also establishes a process for the release of the affected guarantees, it is clarified that the new procedure strengthens the interaction between the southern provincial government and the AFIP, based on its precise functions for the treatment of the origin and constitution of guarantees, seeks to speed up the processes through proper accreditation of compliance with the obligations that arise with respect to the origin regulated for this customs area that conceives a special regime.
