Through an operational procedure carried out in In a customs warehouse in the northern area of Greater Buenos Aires, Customs detected that an importing company was attempting to import 144 motorcycles into the country as incomplete and completely disassembled units, with the aim of applying a tariff reduction to 0%.
The importer intended to access the tariff benefit established in Decree 81/2019, which allows the import of incomplete, fully disassembled motorcycles, exempt from import duties.
But in the detected case they were not in that condition and the import duty rate is 35%. The Customs Office stressed that the regime created by that Decree seeks to promote the national integration of motorcycles and "boost the national industry."
As a result of the verification actions implemented by the agency, it was possible to detect that these were 160cc motorcycles and that several component parts were mounted on the frame, failing to comply with the requirements to be able to enjoy the tariff benefit.
Through this maneuver, The taxpayer intended to enjoy a tariff preference and import the merchandise by applying a 0% rate for Import Duties, when in reality he must pay a rate of 35%.
In this regard, the director of the agency, Guillermo Michel, stressed that "the objective of Customs is to protect the national industry and Argentine employment."
Customs will proceed with the application of the corresponding customs infraction, and the release of the merchandise will only be possible to the extent that the established infraction is complied with.
"As a result of this detected non-compliance, we will proceed with a selectivity system that will allow this type of income under this tariff item to have exhaustive physical and documentary control," the DGA concluded.
