Government sets changes to the Import Licensing Regime

The Government has decided to make changes regarding the processing of Automatic and Non-Automatic Licenses, through the Provision 29/2020.

The regulations of the Undersecretariat of Commercial Policy and Management, published this Wednesday (21.10.2020) in the Official Gazette, indicate in its recitals that "the import licensing system is effective for information on the flow of imports, thereby allowing us to become aware of certain disruptive behaviors in foreign trade. And through this information, It has been determined that there are a number of tariff items (116) that need to be excluded from the Non-Automatic Licensing process.

However, the same Provision establishes that "on the other hand, a series of assets have been identified Regarding which, based on the current economic situation, it is essential to evaluate their trade flows, so it is advisable to include them in Resolution No. 523/17 of the former SECRETARIAT OF COMMERCE and its amendments," that is, that these will indeed process Non-Automatic Licenses.

The respective tariff items are detailed in the five Annexes of the Provision, as provided below:

Article 1.- Annexes II, III, VIII, X, and XI of Resolution No. 523 dated July 5, 2017 of the former Secretariat of Commerce of the former Ministry of Production and its amendments are hereby replaced by Annexes I (IF-2020-69532978-APN-DIMP#MDP), II (IF-2020-69532897-APN-DIMP#MDP), III (IF-2020-69532750-APN-DIMP#MDP), IV (IF-2020-69532226-APN-DIMP#MDP), and V (IF-2020-69977445-APN-DIMP#MDP), respectively, which are an integral part of this measure.

Article 2.- Annex XII of Resolution No. 523/17 of the former Secretariat of Commerce and its amendments are hereby deleted.

Article 3.- Merchandise with Automatic Licenses approved prior to the entry into force of this provision and which, by application of the provisions of this measure, change from processing Automatic Licenses to Non-Automatic Licenses, will be exempt from processing them. They will remain valid until they are used or the term for which they were granted expires, whichever occurs first.

The regulations, signed by the Undersecretary of Commercial Policy and Management, Alejandro Barros, will come into effect on October 22, 2020.
