The National Government suspended the course of the terms of the administrative procedures of the National State, within the framework of the health emergency, from May 26th to 28th next, through the Decree 335 / 2021.
The regulation, published today (25.05.2021/1023/01) in the Official Gazette, provides that all procedures carried out under the National Administration Contracting Regime established by Decree No. XNUMX/XNUMX and its amending regulations are exempt from the measure.
The Executive Branch justified the decision by stating that "currently there is an increase in cases (of coronavirus) in almost all jurisdictions of the country, which is why, by Decree No. 334/21, a series of measures to restrict movement were established, in order to protect the health of the population and avoid the collapse of the health system."
"In this context, and in order to safeguard the rights and guarantees of the interested parties, it is imperative to suspend the deadlines within the administrative procedures regulated by the Regulation of Administrative Procedures," he added.
At the same time, he clarified that this suspension will not apply to the deadlines related to the procedures linked to the declared public health emergency.
Thus, the official text indicated article 1: «The course of the terms is suspended, within the administrative procedures regulated by the National Law of Administrative Procedures No. 19.549, by the Regulation of Administrative Procedures. Decree 1759/72 and by other special procedures, from May 26 to 28, 2021 inclusive, without prejudice to the validity of the acts carried out or to be carried out.«.
The National Executive Branch indicated that in order to guarantee the acquisition and provision of goods and services that are necessary for the different jurisdictions, the procedures carried out under the National Administration Contracting Regime are exempted from the suspension of deadlines.
The Court also considered it necessary to authorize jurisdictions, entities and organizations contemplated in the Law on Financial Administration and Control Systems of the National Public Sector to "provide exceptions regarding the suspension of the deadlines corresponding to administrative procedures, based on the particularities that each of the latter may exhibit in their respective areas."
