Within the framework of the measures adopted by the national Government to accelerate bureaucratic procedures, the following has been published today (20.01.2025). Decree 35 / 2025, which simplifies and streamlines the sanitary management of imports and exports of food and related products. This measure modifies Decree No. 2126/1971, which regulates Law 18.284 on the Argentine Food Code.
Imports
According to official information, food products, packaging and materials in contact with food that have certification from countries with high health surveillance or with which there are economic integration treaties or reciprocity agreements (such as Australia, Canada, Switzerland, the European Union, the United States, New Zealand, Israel, Japan and the United Kingdom) may enter the country through an Import Affidavit. This must be accompanied by a marketing authorization or free sale certificate issued by the competent health authority of the country of origin, regardless of whether they are contemplated in national regulations.
Exports
On the other hand, products intended for export must only comply with the requirements and restrictions imposed by the country of destination. If necessary, this may be requested from the National Food Institute (INAL), an agency dependent on the National Administration of Medicines, Food and Medical Technology (ANMAT), the corresponding health certificates, in those cases in which the receiving country requires it.
The measure will come into force on January 21, 2025, that is, the day after its publication. However, ANMAT is expected to publish the complementary provisions and procedures necessary to implement this new regulation in the coming days.
