Last Friday (02.09.2022) Argentina asked the World Trade Organization (WTO) to open consultations with Peru regarding the tariffs that this country imposed on biodiesel imports, official sources reported.
The Argentine presentation discusses the imposition of six measures relating to antidumping and countervailing duties on that product, according to the WTO document released today.
The Argentine government argued that Peru's measure "appears to be incompatible with several provisions of the WTO Agreements”. In this regard, he referred to the Agreement on Subsidies and Countervailing Measures, Anti-Dumping Agreement, Article VI of the General Agreement on Tariffs and Trade 1994 and Article XVI of the Marrakesh Agreement.
"Peru's measures appear to nullify or undermine the benefits accruing to Argentina, directly or indirectly, from the agreements invoked," the document said.
“Argentina reserves the right to raise, during the consultations, additional measures and claims under other provisions of the WTO Agreement with respect to the above-mentioned issues. We look forward to your response to this request and the setting of a mutually convenient date for consultations,” he added.
The request for consultations is the first formal stage of a dispute at the World Trade Organisation, but it is hoped that "the opportunity to debate" will allow for an "amicable solution" with Peru. "After 60 days, if the consultations have not allowed the difference to be resolved, the complainant may request that it be resolved by a special group," according to WTO rules.
