Argentina: CEP System, a risk management tool, approved

The Federal Public Revenue Administration (AFIP) approved the “Financial Economic Capacity System” (CEF System) as one of the instruments for the risk management in tax, customs and tax administration and social security resources. This system will be based on data provided by the taxpayer or by third parties, in relation to his/her economic, patrimonial and financial status and activity. 

Implementación

In this way, the implementation and application of this CEF System is will be carried out by segmentation and characterization of the taxpayers, which will be established by this Federal Administration through the issuance of general resolutions, which will also indicate the particularities and services covered.

According to General Resolution 4294, the CEF System will be available in the AFIP website (http://www.afip.gob.ar). Likewise, to access the aforementioned system, you must have a Tax Code with a Security Level of at least 3, and enter the “Registration System” service, “Economic and Financial Capacity” option, from where you can learn about the assigned valuation, as well as the functions and options of the system.

Calculation formula

As for the operation of this new measure, it contemplates a formula that calculates a monthly assessment of the Financial Economic Capacity of each taxpayer, which may consist of a certain amount. This parameter will be considered representative of its capacity to carry out, in principle, certain economic acts and their tax consequences or for foreign trade operations.

In this way, to consult the assigned valuation, the interested party must have an established Electronic Tax Domicile, declare and keep updated before this Agency the tax domicile and the addresses of the premises and establishments, if applicable, in accordance with the provisions of current regulations and have updated in the "Registration System" the code related to the activity carried out, in accordance with the "Economic Activities Classifier (CLAE) - Form No. 883".

Reprocessing Request

Another important point of this implementation is that the The taxpayer may request reprocessing, upon presentation of the sworn declarations originals and correctives, as appropriate, so that they may be considered in the new calculation. The request for reprocessing will be made through the “web” service of this Agency “Registration System”, option “Reprocessing Request”.

After carrying out this procedure, within 5 calendar days of the request being made, a new process will be carried out with the updated information and the system will issue the resulting assessment that will be communicated to the Electronic Tax Address. However, Only one reprocessing request may be made per calendar month.
