Customs optimizes the calculation of guarantees for fiscal warehouses

The General Directorate of Customs (DGA) announced this Friday (10.01.2025), an update in the calculation of the guarantees required for the authorization of fiscal warehouses. The measure, established by the General Resolution 5630/2025 published in the Official Gazette, will come into force next Monday, January 13.

As provided, The guarantee will be calculated at a rate of 50 US dollars (US$ 50) or its equivalent in pesos per square meter, with a maximum limit of 2 million dollars (US$ 2.000.000) or its equivalent in local currency..

The initiative has halved the costs for these warehouses. In its comments, the Customs Office stressed that this modification responds to the need to "promote adjustments that favor competitiveness and cost reduction in foreign trade."

The DGA measure is aligned with Decree of Necessity and Urgency No. 70/2023, issued on December 20, 2023, which prioritizes economic reconstruction by eliminating state barriers and promoting greater integration into world trade.

According to the Custom code (Law No. 22.415 and its amendments), customs warehouses located in the primary customs zone require authorization granted by the customs authority, which includes the provision of guarantees to ensure compliance with the tax and criminal obligations of the warehouse keepers.

From 2018, the General Resolution No. 4.352 and its amendments have regulated the procedures and requirements for the authorisation of these operational spaces. However, with the aim of promoting competitiveness in the international arena, Customs has adjusted the amounts stipulated in point 4 of Annex V of said regulations.

This modification represents an improvement for commercial operators, reducing costs and promoting the dynamization of exports, in a context where the National Government seeks to strengthen Argentina's insertion in international markets.
