Automotive sector: Government sets 0% rate on export duties

Due to the positive impact that Decree No. 789/20 and its amendments had on the automotive sector, reflected in the increase in competitiveness, the Executive Branch of the Nation decided to apply the same treatment to incremental exports that take place during the year 2024.

This is established by the Decree 641 / 2024, which comes into effect today (19.07.2024/XNUMX/XNUMX) throughout Argentina.

Accordingly, the text determines that, "with respect to the incremental exports referred to in the Article 2 of Decree No. 789/20 and its amendments and that the provisions contained therein are applicable, the surplus resulting from comparing the FOB value of all exports of goods included in the tariff items of the Common Nomenclature of Mercosur (NCM), listed in Annex II of the aforementioned standard, shall be considered. Clarifying that, for which purposes, the provisions of Decree No. 557/23 and its amendments, made by Each company registered in the Registry created in the second paragraph of article 5 of the aforementioned decreeo, during the year 2024, Regarding exports of the same goods that were made during 2020. (See Art. 1 of Decree 641/24).

Decree 789 / 20

This rule sets out in zero percent (0%) the Export Duty (ED) rate for incremental exports of goods included in the Common Nomenclature of Mercosur (NCM), which are recorded in Annex II (IF-2020-66477157-APN-SIECYGCE#MDP) which for all purposes forms an integral part of this decree, in terms of their FOB value, made by each exporter until December 31, 2022, considering 2020 as the base period. (The expression "until December 31, 2021" replaced by "until December 31, 2022", by art. 1 of Decree No. 831/2021 BO 6/12/2021. Validity: from the day of its publication in the OFFICIAL BULLETIN and will be applicable from that date.) 

Likewise, the goods covered by the provisions of the preceding paragraph shall not be subject to any other export duty rate other than that established therein.

Supplementary rules 

  • Decree 1060/20: The export duty rates for various tariff items of the COMMON NOMENCLATURE OF MERCOSUR (NCM) corresponding, among others, to the automotive industry are modified, and the maintenance of the provisions contained in article 2 of Decree No. 789/20 was also foreseen.
  • Decree 150/21: It establishes the continuity of the benefit provided for in article 2 of Decree No. 789/20 and the base period to be considered for determining the incremental amount was adjusted.
  • Decree 831 / 21: It expands the universe of tariff items included in the benefit and includes certain vehicle parts and accessories, in order to promote their export to new markets and improve their competitiveness, starting January 1, 2022.
  • Decree 81/23: It provides that incremental exports made during 2023 would be subject to the treatment provided for in Article 2 of Decree No. 789/20.
  • Decree 557 / 23: Approves the Common Nomenclature of MERCOSUR (NCM), adjusted to the VII Amendment to the Harmonized Commodity Description and Coding System.
