Paraguay enacted an agreement with the United States regarding mutual customs assistance

The President of the Republic of Paraguay, Mario Abdo Benítez, promulgated the 6796 / 2021 approving the revised agreement with the United States Government regarding mutual assistance and exchange of information between their customs administrations.

The rule, published on Friday (20.08.2021) in the Official Gazette of the Republic of Paraguay, aims to discourage any form of fraud or illicit activity that violates the economic, fiscal and security interests between both countries.  In this regard, enhances trade facilitation and security cooperation.

To that end, the updated Customs Mutual Assistance Agreement provides a roadmap for how U.S. Customs and Border Protection (CBP) and Paraguay's Customs Administration will work together to enforce customs law in both countries, as well as accurately assess tariffs and other taxes.

The instrument provides the legal framework for the exchange of information and the implementation of modern and reliable customs regulations (adapted to international standards) applied to tax evasion, trafficking, proliferation, money laundering and activities related to terrorism, among other matters.

The agreement includes mutual assistance in the prevention, detection and investigation of any customs infringement in order to establish effective cooperation, in accordance with the legal provisions of the signatory States.

The implementation of the agreement will contribute to the legal strengthening of the State in giving attention to the identification of risks, the referral of judicial proceedings and the sanctioning of offenders with the rigor of the law.

The agreement update was signed on 13 of July 2020 (replaces the one signed between both countries in 2002), approved by the Senate on May 27, 2021 and by the Chamber of Deputies on August 4, 2021.
