New measures to facilitate tourism exchange between Argentina and Chile

The Federal Administration of Public Revenues (AFIP) established a alternative procedure to the single form “Temporary Departure and Administration of Vehicles Argentine-Chilean Agreement” (OM-2261), through the General Resolution 5460/2023.

The regulation, published today (13.12.2023) in the Official Gazette, provides that the temporary admission and exit of private vehicles used for tourist trips, with a license plate of the Republic of Chile or the Argentine Republic, will be carried out within the framework of the Argentine-Chilean Tourism Agreement, approved by Law No. 23.825, in accordance with the provisions of Annexes I, Annex II, Annex III, Annex IV and Annex V, which become part of the Resolution issued for these purposes.

The official text clarifies that maintains the Car Entry and Exit System (ENYSA) and a procedure established in General Resolution No. 2.623 is repealed and its amendment.

In the recitals, the AFIP explains that the measure is in order to promote the advancement of the "paperless» of customs operational processes by applying coordinated border management instruments as established by the World Customs Organization (WCO) and in order to facilitate tourism exchange.

Scope

a) Automobiles -including jeep and station wagon types-, pickup trucks, motorcycles, motorized bicycles, motorized motor homes and others with similar characteristics.

b) The drag ones that accompany those indicated in the previous section, without their own traction, such as: mobile homes, trailers, etc., provided that they do not transport cargo and/or passengers for commercial and/or industrial purposes.

Excluded

The following will not be covered by this provision: rental vehicles and vehicles with a license plate identification number (license) of a State Party to the MERCOSUR or registered in a third country, which will be governed by their specific rules.

controls

In this sense, the mentioned vehicles will be subject to the selective controls that the customs authority may carry out to verify compliance with the conditions and requirements set forth in this standard.

Sanctions

If non-compliance with the obligations established in this regulation is verified, the responsible party will be subject to the sanctions and precautionary measures provided for in the Customs Code - Law No. 22.415 and its amendments.

This measure will come into force as of December 13th 2023.
