As part of its regulatory simplification process, the Customs Collection and Control Agency (ARCA) announced today (27.12.2024) new measures aimed at streamlining customs procedures and facilitating foreign trade. Among the main actions is the elimination of the figure of the Scanning Service Provider (TOUGH) and the Customs Transit Security Initiative (ISTA), through the official publication of General Resolutions No. 5621 and 5622, respectively.
The ARCA explained that, at the time, the General Resolution No. 3.249 of 2011 had established the figure of the PESE as responsible for the provision of package and container scanning services, as well as the processing, inventory and conservation of images obtained during the inspection process. However, with the incorporation of new equipment for non-intrusive inspection of goods, security in the foreign trade logistics chain was increased, improving the efficiency of customs controls.
Based on the experience gained and the new needs of the sector, ARCA considered it appropriate and timely to eliminate the PESE figure in order to simplify procedures and optimize resources allocated to customs supervision.
In addition, the ARCA has decided to repeal the Customs Transit Security Initiative (ISTA), established by General Resolution No. 4.288 of 2018. This measure regulated carriers wishing to carry out import transit destinations by land under a specific regulatory framework, which included their registration in the “Special Customs Registries”. Subsequently, General Resolution No. 5.451 of 2024 introduced a new guarantee scheme that ISTA Providers had to establish to cover possible charges and sanctions in the event of non-compliance with the Monitored Customs Transit of Importation (TRAM). After evaluating the effectiveness of these measures, ARCA decided to repeal Resolution No. 4.288/2018 as part of its regulatory simplification process.
Furthermore, it is important to remember that, days ago, General Resolution No. 5619/2024 repealed the table corresponding to “Secure Logistics Operator (SLO)”” in the Title “Special Records” of the section “Specific Requirements”. This voluntary system, created by the former AFIP in the General Resolution No. 2665 of 2009, It was aimed at warehousemen, customs transport agents and carriers who joined the OLS system spontaneously and individually.
With these decisions of immediate effect, ARCA continues to make progress in its objective of simplifying and optimising customs procedures, reducing the administrative burden for foreign trade operators.
