The National Government granted a new extension so that corn exporters can meet the commitments made in the International Trade.
Through Resolution 78 / 2023, published this Wednesday (08.03.2023) in the Official bulletin, the Ministry of Agriculture, Livestock and Fisheries -dependent on the Ministry of Economy-, granted “ an Exceptional Automatic Extension of ONE HUNDRED AND EIGHTY (180) calendar days, to the Foreign Sales Affidavits (DJVE) with a shipping period between March 1, 2023 and July 31, 2023, counted from the end of shipment plus the automatic extension for the merchandise included in tariff item No. 1005.90.10 (GRAIN CORN). The period arising from the above will constitute the new maximum period of validity of the DJVE.”
However, it was clarified that the extension "will not apply to those Foreign Sales Declarations that were registered after the entry into force of this measure, nor to DJVEs that are registered with a validity period of 30 days."
In the recitals, the portfolio explained that the decision was made "as a consequence of the severe drought affecting the entire territory of the Argentine Republic" And since corn is a product that is highly affected by this climatic condition, "it is necessary to adopt concrete measures in order to contain the consequences that could occur and their implications in the agricultural export scenario."
The Government stated that the Cereal Exporters Center (CEC) formalized a presentation dated February 7, 2023, detailing the same problem.
He also stressed that this is an “extraordinary and exceptional situation” but insisted that it is “necessary” to promote the care of all agents involved in the grain trade chain.”
“Given the exceptional particularities presented by the current scenario of “agricultural emergency”, and “for the purposes of facilitating future decision-making on the matter”, the Executive Branch considered it appropriate to authorize the Undersecretariat of Agricultural Markets of the Secretariat of Agriculture, Livestock and Fisheries, to dictate “the complementary and clarifying norms that are necessary for the implementation of this measure within the scope of its competence, as well as the future adjustments that are essential to maintain the normal flow of the export operation of the aforementioned products”.
In Article 4 of the published resolution, it was stated that the same reasons for force majeure “may be alleged by the actors in the chain in the event of non-compliance with respect to the exporters, who must admit this circumstance.”
