Argentina incorporated into its legal system regulations established by Mercosur for consumer protection in electronic commerce, through the Resolution 270 / 2020 of the Secretariat of Domestic Trade, published this Tuesday (08.09.2020/XNUMX/XNUMX) in the Official Gazette.
The measure establishes that "In electronic commerce, consumers must be guaranteed, throughout the transaction process, the right to clear, sufficient, truthful and easily accessible information about the supplier, the product or service and the transaction carried out.«.
Following the incorporation of this regulation, the supplier must make available to consumers, "on its website and other electronic media, in an easily visible location and prior to the formalization of the contract", the commercial and corporate name, the physical and electronic address, and the customer service email address.
It must also include the tax identification number, the identification of the manufacturer and registration of products subject to prior authorization regimes, if applicable; and the essential characteristics of the product or service, including the risks to the health and safety of consumers.
In addition, the price must be included, including taxes and a breakdown of any additional or accessory costs, such as delivery or insurance costs; and the payment methods detailing the number of installments, their periodicity and the total financial cost of the operation, in the case of installment sales.
Likewise, the terms, conditions or limitations of the offer and availability of the product or service must be visible; and the conditions to which the legal and contractual guarantee of the product or service is subject; and any other relevant condition or characteristic that must be known to consumers.
The regulation determined that "the provider must ensure easy access and clear visibility to the terms of the contract, ensuring that they can be read, saved or stored by the consumer in an unalterable manner."
