The Federal Public Revenue Administration (AFIP), through the General Directorate of Customs (DGA), repealed General Resolution 4.948, a regulation that was in force for several years to regulate reference export values.
This decision was published on Thursday (12.09.2024) in the General Resolution 5562/2024 and seeks to adapt customs control to the new fiscal and productive needs of the country.
According to the recital, the measure complements General Resolution 4.710, and It arises as a response to the need to improve control mechanisms in Argentine exports, especially in the context of Decree 697/2024, which established a 0% rate on export duties for a group of products, with special emphasis on agricultural activity.
According to the DGA, the export reference values, designed as a preventive mechanism, allowed the authorities to detect deviations in the declared prices of identical or similar goods, thus safeguarding tax revenue. However, after the implementation of the new zero-withholding scheme, Resolution 4.948 ceased to be relevant, which led to its repeal.
In this regard, the current regulations clarify that “Exports that were under the tariff items regulated by the repealed resolution must follow the selectivity procedures established in General Resolution 1.921 and its amendments. However, such destinations may be selected based on risk analysis and/or auditing to be subject to value control, in which case they will be processed through the red channel.
This complementary measure is part of the various actions that AFIP has implemented this year to improve control and facilitation mechanisms, in response to the evolution of the economy and the needs of Argentine foreign trade. The General Resolution will enter into force on September 13, 2024.
