Withholdings for SMEs are eliminated

The Government has ordered the elimination of export duties (withholdings) for all companies that export above their average exports from last year, whose amount was less than US$ 50 million per year. 

The measure was announced through the decrees 280 y 335 published in the Official Gazette this Tuesday (7.5.2018) with the signature of the President of the Nation, Mauricio Macri, the Chief of Cabinet, Marcos Peña and the Ministers of Production and Labor, Dante Sica and Finance, Nicolás Dujovne.

On the one hand, decree 280 establishes that "lMicro, Small and Medium Enterprises (MSMEs) may access the treatment provided for by this decree provided that the exports they have made in the immediately preceding calendar year have not exceeded fifty million US dollars (US$ 50.000.000).«.

Meanwhile, decree 335 limits this measure. Thus, it states that "For subjects who have made exports in the immediately preceding calendar year, the annual amount subject to tax relief may not exceed six hundred thousand US dollars (US$ 600.000).

The text adds that "For subjects existing at the time of publication of this decree, who have not made exports in the immediately preceding calendar year, the annual amount subject to tax relief may not exceed three hundred thousand United States dollars (US$ 300.000).«.

This regulation clarifies that exports carried out on behalf of and on behalf of third parties will not be considered under the measure.

The decrees will come into force as of May 8th 2019.
