The Ministry of Industry and Productive Development approved this Thursday (01.08.2022/XNUMX/XNUMX) the regulation of the registry, through which vehicle and auto parts manufacturing companies will be able to access exemption from paying withholding taxes on their incremental exports.
This is established by the Resolution 1 / 2022 published in the Official Gazette, a measure that will come into effect as of tomorrow (02.09.2022).
The measure establishing zero rates for incremental exports was first established in March 2021 for exports of that year and, in December of that year, the benefit was extended until the end of 2022, extending the universe of tariff items included to certain auto parts, and creating the registry of companies for access to said benefit.
In this context, through today's resolution the terms of the agreement were established. Registration of Companies that Manufacture Motor Vehicles and/or Auto Parts, companies will be able to access the benefit through which companies will pay withholdings at the current rates (4,5% or 3%) until amount of exports invoiced in 2020, the year taken as the comparison period.
Once this amount is exceeded, new exports or incremental exports will be taxed at 0%.
The new resolution establishes the terms, conditions, formalities and requirements for registration, in addition to drawing up an initial list of companies that are likely to be covered by the benefits and which will serve as a basis.
In this way, the more than 100 companies that are already included in the list - which are recognized as manufacturers by the sector's chambers - will not have to complete the procedure to obtain the tax benefit.
In order to access the benefit, companies not included must register on the Remote Procedures Platform (TAD), prove that they are producers of said goods and be registered in the Single Registry of the Productive Matrix (RUMP).
The regulation also provides the mechanism by which companies must verify any changes in their status as manufacturers of goods.
The Directorate of Automotive Policy and Special Regimes of the Ministry of Economy will have 30 calendar days to respond to the requests and analyze the documentation submitted, and will implement, together with the Federal Administration of Public Revenues (AFIP), the mechanisms that are necessary to implement to make the regime operational.
