The Ministry of Productive Development proceeded to maintain in force the opening of an examination due to expiration of the term of an antidumping measure on butt-welding pipe fittings (fittings), originating in the People's Republic of China.
According to Resolution 552 / 2020, published this Thursday (15.101.2020) in the Official Gazette, the portfolio states: «The opening of an examination due to expiration of the term of the antidumping measure imposed by Resolution No. 1.181 dated October 23, 2015 of the former Ministry of Economy and Public Finance, to the export operations to Argentina of butt-welding pipe fittings (fittings) - elbows, except 180° elbows and reduction elbows, and tees - of carbon steels, in various forms, manufactured according to ASME B16.9 and ASTM A234 standards or equivalent standard (IRAM 2607, etc.), of external diameters equal to or greater than sixty point three millimeters (60,3 mm) (two inch (2”) designation) and less than or equal to three hundred twenty-three point eight millimeters (323,8 mm) (twelve inch (12”) designation) in standard thicknesses and extra heavy, originating in the People's Republic, merchandise classified in the tariff items of the Common Nomenclature of Mercosur (NCM) 7307.19.20 and 7307.93.00."
The decision is based on several considerations. For example, the recitals state that “…in light of the positive determination made by the Undersecretariat of Commercial Policy and Management and the conclusions reached by this Commission, developed in the preceding paragraphs, (…) the conditions required by current regulations have been met to justify the initiation of an examination due to the expiration of the term of the antidumping measure imposed by former MEyFP Resolution No. 1181/2015 dated October 23, 2015.”
For this reason, the Ministry of Productive Development decided to maintain in force the measures applied by Resolution No. 1.181/15 of the former Ministry of Economy and Public Finance, to the export operations to Argentina of butt-welded pipes (fittings), originating in China until the review procedure initiated is concluded.
As is known, dumping is the practice developed by a company when it exports a product to a foreign market at a price lower than that charged for the same product in its domestic market (price discrimination).
According to WTO rules, this practice may be subject to corrective measures (application of anti-dumping duties) when it causes significant damage to a domestic industry in the importing country, in order to preserve the conditions of competition between domestic and imported products.
