DNU 70/2023: dispatchers present constitutional demand for protection and precautionary measures

As part of the actions that ensure the exercise of legitimate defense of the profession, the Customs Brokers Center of the Argentine Republic (CDA) has filed this Friday (29.12.2023/XNUMX/XNUMX) a claim for protection before the Federal Administrative Litigation Judge to declare the unconstitutionality of the Articles 98 to 104 of Decree of Necessity and Urgency 70/2023 (DNU); and that, as a precautionary measure, the AFIP be ordered to refrain from applying such articles until a definitive ruling is issued on the matter.

The CDA expressed its concern regarding the changes introduced by the DNU. 

"This action is, in addition to a legal action, an expression of our unwavering commitment to the defense of our profession and the history of a century-old institution," the dispatchers said in a statement. 

After clarifying that “the Center’s legal team has worked hard to prepare these legal resources, seeking to protect the interests of all our partners and maintain an equal environment for the exercise of our responsibilities,” the CDA stated: “We are aware of the uncertainty and unrest that Decree 70 has generated.”

"For this reason, the institution acted accordingly, explaining to society what role we perform professionally and the risks involved in the performance of our activity by people without prior preparation and training," he said.

The CDA also said that “this presentation is for us and for society as a whole.” And, if necessary, it proposed: “let us work together on an update of the Customs Code, in order to develop a joint action plan that allows us to continue evolving, taking into account the interests and needs of all the parties involved.”

Finally, the group of professionals in Argentina stressed that it “will keep all members informed of any additional developments and hopes to count on their active participation in this important moment for our community.”
