Commission of Jurists for Regional Integration calls for the prompt entry into force of the Mercosur Customs Code

The Commission of Jurists for Regional Integration, an organ of the “Consultative Council of Civil Society” of the Ministry of Foreign Affairs and Worship of the Argentine Republic, issued a statement for the prompt entry into force of the Mercosur Customs Code.

According to the statement dated 17.04.2023/XNUMX/XNUMX, "it is advisable that the Republic of Paraguay and the Eastern Republic of Uruguay, as soon as possible, adopt the necessary measures for the incorporation of the aforementioned code."

According to the jurists, given the relevance of the validity of the customs code, "it is necessary that this issue be included in the permanent agenda of the MERCOSUR Trade Commission, in order to follow up on the internalization process in the Member States that have not yet done so."

They say that the entry into force of this common customs regulation will not only consolidate the integration process but will also boost the bloc's external agenda by facilitating the negotiation of new trade agreements with third countries or groups of countries.

The Commission of Jurists for Regional Integration urges the national Government, "in its capacity as Pro Tempore Presidency of the bloc, to include the prompt entry into force of the community customs code on the agenda of the MERCOSUR Trade Commission (CCM), as has occurred in the past with similar issues (see, for example, on the validity of CMC Decision No. 33/15, minutes No. 05/18 of the CLXa ordinary meeting of the CCM, 18-19/09/18, point 4.1)”.

This commission was created in 2005, within the framework of the Civil Society Advisory Council, thanks to the initiative and drive given by Drs. Amarelle, Rosano and Violini; at that time under its name “Commission of the Legal Profession for MERCOSUR”.

The space is made up of jurists specialized in different branches of law, whose objective is to analyze and study the law of regional integration (MERCOSUR) and its impact on the positive law of the States Parties; and to compare it with that of other American and European state integrations, oriented towards the practical activity of lawyers, officials of the three branches of government, academics and legal operators in the regional sphere.

The Commission's opinion is not binding, but may be consulted by the Council if it deems it appropriate.
