CDA: Cartagena Declaration, a historic milestone

The Board of Directors of the Customs Brokers Center (CDA) has been making a strong commitment to participating in regional and international organizations together with entities that represent colleagues from other countries, convinced that the best way to strengthen and enhance the profession is by working together.

La Cartagena Declaration, approved by all ASAPRA members present in that Colombian city on the basis of a document presented by the CDA, constitutes a historical milestone.

At a time when new trends in international trade pose new challenges to many of its protagonists, including the Dispatchers themselves, this text establishes clear definitions about its function, their own responsibilities and those of other actors.

The document, which took several months of work, was prepared by a commission made up of Enrique Loizzo, Oscar Dhers and the lawyers Héctor Guillermo Vidal Albarracín and Guillermo Vidal Albarracín.

It is the basis of the Cartagena Declaration, which incorporates the observations made by four associations and resulted unanimously approved, by representatives of Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, El Salvador, the United States, Spain, Guatemala, Mexico, Nicaragua, Panama, Paraguay, Peru, the Dominican Republic and Uruguay.

In order for customs agents to be able to fulfil their function, their rights and duties must be harmonised, with clear statements that do not give rise to different interpretations. As they are auxiliary agents of customs, this role must be compensated by the non-application of sanctions for minor or involuntary errors.

In this sense, the The objective is to interest judicial magistrates in the activity of the Dispatcher, with the conviction that this knowledge will make it possible to limit criminal liability and distinguish between obligatory acts and those that are mere collaboration.

The Cartagena Declaration is a source of pride for Argentinean Shipping Agents, confirms the importance of the CDA's regional and international work and commits us to a renewed effort.
