New operational modality for customs surety insurance in the RIGI

On September 24, 2024, the National Insurance Superintendency (SSN) published in the Official Gazette the Synthesized Resolution 465, which enables insurance entities to apply a new operating modality in the Large Investment Incentive Scheme (RIGI), intended to ensure compliance with customs obligations.

El RIGI It was created by Law No. 27.742 and regulated by Decree No. 749/24, with the aim of encourage large investments both national and foreign, contributing to the economic development of the country. This regime aims to promote the competitiveness of economic sectors key, offering incentives for projects that boost the Argentine economy.

To this end, the Federal Public Revenue Administration (AFIP) submitted a request to establish a new operating mode within the customs guarantee insurance, which guarantees the rights related to imports made under this regime. Among the obligations it covers are the payment of import duties, the statistical tax, verification of destination, and other national and local taxes.

In response to the request of the AFIP, the  National Insurance Superintendency determined that the contractual conditions contemplated in the General Resolutions SSN No. 30.711/2005 and No. 31.584/2006 They already cover the general guidelines established for customs guarantees in this context. Therefore, no substantial modifications to these regulations are required, but the new operating modality of the RIGI is incorporated.

Thus, Summarized Resolution 465 also provides for the incorporation of the RIGI into the list of current operating modalities of the customs guarantee surety insurance, as stated in Annex I of SSN Resolution No. 33.523/2008. This step allows insurers to offer specific coverage for operations under the regime, consolidating the regulatory framework that facilitates large investments in Argentina.
