The Government established a comprehensive control over the Importation of goods subject to antidumping or countervailing duties, or are under analysis of applying such rights, in which cases said imports will process their entry through the red selectivity channel, according to the Resolution 366 / 2020
The decision implies that such Merchandise will be subject to physical and documentary control plus value analysis after the merchandise is released to the market., states the regulations published this Monday (27.07.2020) in the Official Gazette.
The official text explains “That in accordance with the provisions of the aforementioned resolution, The red channel consists of documentary control, physical verification and value analysis after the release of the merchandise..
It is appropriate to grant the treatment described above to import destinations for consumption of goods that at the time of entry into force of this resolution or in the future, are affected by current measures that establish definitive antidumping or compensatory duties, or are subject to investigation with a preliminary determination in the terms of Chapter III of Decree No. 1.393/08, whether or not they have applicable provisional measures, taking into account that said goods declared as subject to dumping or subsidies are causing damage to the national production branch or are being investigated, which requires physical verification and analysis of the value after the release of the merchandise.".
The Government determines "Inform the General Directorate of Customs, dependent on the Federal Public Revenue Administration, that the control of import destinations for consumption of goods, regardless of the declared origin, which at the time of the entry into force of this resolution or in the future, are covered by current measures that establish definitive antidumping or compensatory duties, as well as those that are the subject of an investigation process in which a preliminary determination of the existence of dumping, subsidy or injury has been made, or its continuity has been ordered, whether or not they have applicable provisional measures, in the terms of Chapter III of Decree No. 1.393 dated September 2, 2008, be carried out in accordance with the verification procedure provided for cases processed through the red channel of selectivity, according to the description in point 1.3 of Annex I of Resolution No. 44 dated April 29, 1998 of the General Directorate of Customs.
For this purpose, it will be physically verified that the goods correspond to the gloss of the tariff position by which they are classified as well as with their corresponding SIM opening, if applicable.".
This Resolution shall enter into force starting Monday, August 3, 2020.
