Modifications to the common nomenclature of Mercosur are made official

The Government validated all the modifications made to the Common Nomenclature of Mercosur (NCM), referring to external tariffs on certain goods during 2017 and 2018, through the decree 541/2019.

The regulation, published this Tuesday (06.08.2019), introduced into the Argentine legal system the changes approved at a regional level in resolutions, in order to make adjustments to the lists of exceptions to the AEC, of ​​Capital Goods (BK) with Differential Extra-Zone Import Duty, of Information Technology and Telecommunications Goods with Differential Extra-Zone Import Duty (0%)), of Export Refund Exceptions and Export Duties.

The official text highlights that the Common Market Council authorized Argentina to maintain until December 31, 2021, a National List of Exceptions to the Common External Tariff (CET) of up to 100 NCM codes.

Likewise, the authorization given to the Mercosur Member States is renewed so that they can maintain the current national regimes for the importation of capital goods until December 31, 2021.

The regulations provide that Argentina and Brazil may apply a different rate of the AEC until December 31, 2021 for goods considered Information Technology and Telecommunications (BIT), as well as for the integrated systems that contain them.

In turn, the authorization given to the Member States to temporarily raise, for 100 tariff items of the aforementioned regional tariff instrument, the import duty rates applicable to extra-zone trade above the AEC is extended, and may not be higher than the maximum tariff consolidated by each Member State before the World Trade Organization (WTO).

The decree specifies that, without prejudice to the modifications to be introduced based on the enactment of the aforementioned Community regulations, certain adjustments must be made to the tariff treatments provided for in the lists of Exceptions to the AEC, in the list of Capital Goods, and in the list of Information Technology and Telecommunications Goods.

Also in the area of ​​rates subject to temporary tariff increases, in order to harmonize the exercise of the powers granted at the community level with the other policies undertaken by the Government in the economic and productive sphere.

The decree concludes by stating that in order to avoid the regulatory dispersion of the various regimes referred to, it is advisable to consolidate all of the modifications mentioned in a single regulation.
