New operational circuit for Argentina-Chile exports

Within the framework of guidelines suggested by the WCO regarding the implementation of technology that streamlines logistics in the international marketing chain, the Argentine Government has decided to implement the “Export Operational Circuit – Mendoza Uspallata (COEMU)”, by General Resolution 5446/2023.

The decision, published today (16.11.2023) in the Official Gazette, aims to decongest the step of the exports originating from tax warehouses Authorized within the jurisdiction of the Mendoza Customs in order to provide an operational place of exit from the customs territory at the international crossing System Cristo Redentor – Uspallata, where the Integrated Control Area (ACI) operates, in which the control agencies of the Republic of Argentina and Chile intervene.

Requirements and approval 

To do this, tax warehouses must: register for the use of this operating system, complying with the provisions of Annex I of this standard. 

Such request will be analyzed by the Department Mendoza Customs within a maximum period of thirty (30) administrative working days counted from the submission of the application. The customs administrator of said jurisdiction will issue a preliminary report detailing the operational aspects for the exercise of customs control in accordance with the particularities of the circuit in question. Said report will be sent to the Regional Customs Directorate in order to endorse - or not - it.

Once this is accomplished, the General Subdirectorate of Customs Operations of the Interior, will evaluate - within the framework of the strategies established by the General Directorate of Customs - the existing operational demands and the resources available to adequately exercise customs control, and will issue a decision, within a maximum period of sixty (60) administrative business days, on the admission or rejection of the application for registration to operate in the “Operational Export Circuit – Mendoza Uspallata (COEMU)”.

Once approved, the authorized operators will be included in the “Export Operational Circuit – Mendoza Uspallata (COEMU)” on the website of this Federal Administration (https://www.afip.gob.ar).

Cargo precautions 

  • Electronic Customs Monitoring Seal (PEMA).
  • Control by using a Non-Intrusive Control Equipment of general cargo -container scanner-, in accordance with the technical requirements established for this type of equipment in General Resolution No. 4.352, its amendment and supplements.

Operational control 

Authorized ISTA providers will be responsible for the provision, placement and removal of the Electronic Customs Monitoring Seals (PEMA).

Operators using the “Export Operational Circuit – Mendoza Uspallata (COEMU)” will assume the costs associated with the operations described in this standard.

Such operators will receive a Differential treatment, which guarantees its smooth and safe circulation, as long as the logistics and operational infrastructure of the Uspallata complex allows it and no alerts arise from the monitoring carried out during its movement. Notwithstanding this, the loads that circulate under this circuit are not exempt from other controls that the customs service may determine.

For its part, the regulation establishes that adjustments may be made to the processes and procedures established by the General Subdirectorates of Customs Operations of the Interior, Customs Control, Collection and Customs Legal Technician and the Directorate of Customs Process Reengineering, within the scope of their respective competencies. Such eventual modifications and/or extensions will be communicated through the Customs Electronic Communication and Notification System (SICNEA), in the terms of General Resolution No. 3.474 and its amendments, at the same time as they will be published on the microsite "Operational Export Circuit - Mendoza Uspallata (COEMU)" of this Agency's website (https://www.afip.gob.ar). 

Term 

The period for the arrival of the merchandise from the exit of the fiscal warehouse authorized in the jurisdiction of the Mendoza Customs, to the Cristo Redentor Operational Division may not exceed six (6) hours.

Breach 

Non-compliance, total or partial, of the obligations set forth in this general resolution will give rise to the application of the sanctions provided for in the Customs Code and complementary regulations; this, without prejudice to the application of disciplinary sanctions of warning, temporary revocation (suspension) or definitive revocation of the authorization.

Validity

This Resolution is in force immediate.
