UAI: Money Laundering and International Trade, the key points of the day

Government officials participated in the "Conference on Money Laundering and International Trade" as part of an academic activity, which took place last Thursday (5.4.2018) at the Universidad Abierta Interamericana (UAI).

The first meeting was organized under the coordinationion of Dr. Javier Barraza, in his dual capacity as Director of the Master's Degree in Administrative Law of the UAI and of the Institute of Administrative Law of the Argentine Association of Constitutional Justice, jointly with Dr. Claudia Marinelli as Director of the International Trade Program at the UAI and of the Institute of Customs Law and International Trade of the aforementioned Association.

The key themes of the day were developed with brilliant presentations by featured speakers such as the Vice President of Banco Nación, Dr. Agustín Pesce and the Members of Chamber F of the Tax Court of the Nation, Doctors Christian González Palazzo and Pablo Garbarino, respectively.

El Vice President of Banco Nación referred to money launderingIn particular, he explained the social problems involved and the possible solutions to be provided by the financial system to the irregularity of an informal economy that operates in parallel to the formal one. He also developed the preventive procedure by the State for the detection of such a crime and the importance of a judicial system that supports this task. In this regard, he highlighted the courage of the officials who, even at personal risk, pursue and report this crime, mainly linked to smuggling, trafficking and commercialization of narcotics, terrorism and human trafficking.

Dr. Christian González Palazzo, Member of the Tax Court

In the same line, the Dr. Christian González Palazzo, expressed the importance of the justice service provided by the National Tax Court and the important jurisdictional function in preserving the rights of those administered and, consequently, the interests of the State as a whole. At the same time, the Member of the Tax Court made assessments on the customs procedure, the impact of International Treaties on the substantiation of the same and the role that the Court has in this regard. And he explained the need to adapt the procedures established in the Customs Code to the standards required by the American Convention on Human Rights, particularly delving into the matter of nullities and reasonable time as conventional guarantees and the Tax Court of the Nation, "its reality."

Dr. Pablo Garbarino, Member of the Tax Court

In turn, the Dr. Pablo Garbarino pointed out the lack of authority to apply fines and other sanctions by administrative bodies, the subject matter being the guarantee of due process and the right of every person to be heard by a competent, independent and impartial judge or tribunal, all of which is provided for in the National Constitution and various International Human Rights Treaties of constitutional rank. He also pointed out the position of the Supreme Court of Justice of the Nation, which has peacefully maintained, in successive pronouncements, that the judgment of infractions must follow the guidelines that correspond to the judgment of crimes, which implies the full application of the principles of Criminal Law in the area of ​​infractions. It was concluded with respect to the scope of competence of the Administration in the exercise of jurisdictional powers in criminal matters and in the sense of the obligation on the part of the Argentine State to guarantee every person the right to be heard by an impartial tribunal in the substantiation of any criminal accusation formulated against him.

At the end of the day, before the crowded audience, made up of students, graduates and professors of the International Trade Degree and the Master's Degree in Administrative Law and Members of the Argentine Association of Constitutional Justice, as well as the general public, the Dr. Claudia Marinelli said: «The large audience and the prestigious participation of the excellent speakers honored our High House of Studies with their presence, turning this day into a successful event and convening for the creation of others that will follow it«.
