The Government proceeded to extend the validity period of Non-Automatic Licenses (whose term is 90 calendar days) provided that there are well-founded reasons for it and the request for extension is submitted 15 days prior to expiration, through the Resolution 133 / 2020.
The novelty of the measure, published this Wednesday (05.08.2020) in the Official Gazette, It also involves automatic licenses that are associated with the same presentation with the Non-Automatic ones, that is, in the same SIMI, in which case the extension granted to the Non-Automatic License will be extended to the Automatic License.
In the recitals, it is held: "That in cases where a single declaration registered in the Comprehensive Import Monitoring System (SIMI) includes both “Automatic” and “Non-Automatic” Import Licences, the operation of the requests for extensions of the latter has demonstrated operational difficulties in relation to the prior expiration of the term of the Automatic Licences involved in the same declaration.
That, consequently, by applying the principles of reasonableness and simplicity of administrative procedures, it is appropriate to make the necessary adjustments to the applicable regulations, in order to avoid obstructing import operations involved in the cases referred to in the preceding paragraph.".
Accordingly, the Resolution states:
"Article 12.- Import Licenses will have a validity period of ninety (90) calendar days counted from the date of their approval in the Comprehensive Import Monitoring System (SIMI). This period may be extended by the Enforcement Authority, at the request of the interested party, at least fifteen (15) days prior to its expiration and for well-founded reasons.
The extension that may be granted for the expiration of Non-Automatic Import Licenses will be extended to the validity period of the Automatic Licenses that may be included in the same declaration registered in the Comprehensive Import Monitoring System (SIMI)..
In these cases, if the validity period of the Automatic License has expired, it will be understood that the granting of the extension implies its renewal, until its expiration date..
This measure will come into effect as of Thursday August 6 of 2020.
