The Government established new instruments for interaction with the parties involved in the consultations and responses to requests on dumping, through the Resolution 77 / 2020.
The measure, published this Tuesday (09.06.2020/XNUMX/XNUMX) in the Official Gazette, provided that the Procedures for alleged dumping will be carried out through the website www.argentina.gob.ar and/or by email.
The official text explains that "the incorporation of the aforementioned procedures into the electronic platform "Trámites a Distancia" (TAD) is still in process, by the competent body, for investigations into unfair commercial practices and examinations of the antidumping measures in force due to expiration of the deadline or change of circumstances that are processed by Electronic File Management, it is in the development stage."
The reason for the measure is supplemented by the mandatory preventive social isolation that requires remote processing of files.
Therefore, the recitals state that "In order to ensure the normal functioning of the investigation procedures for alleged dumping or subsidies within the framework of the provisions of Article 6 of the Agreement on the Implementation of Article VI and Article 12 of the Agreement on Subsidies and Countervailing Measures, which does not admit delays, It is necessary to provide tools to make this task compatible with health care. that the exceptional situation requires to prevent contagion and the spread of the virus to the detriment of public health.”
In the resolution section, it is stated: «Interested parties must, for the duration of the measure of "social, preventive and mandatory isolation" established by Decree No. 297 dated March 19, 2020 and its amendments, make their presentations and respond to requests within the framework of the investigation procedures for alleged dumping or subsidies, by means of notes and documentation in digital form through the official site, accessing through the link “https://www.argentina.gob.ar/produccion/mesa-entradas-aspo/formulario-tramites” and/or to the email address [email protected], corresponding to the General Entry Desk of the Document Management Directorate of the Administrative Management Secretariat of the Ministry of Productive Development, in relation to the Undersecretariat of Commercial Policy and Management of the Secretariat of Industry, Knowledge Economy and External Commercial Management of the aforementioned Ministry, obtaining as proof of the start of the procedure an Electronic File number within the Electronic Document Management System (GDE), for its subsequent monitoring.
The provisions of the Resolution, signed by the Secretary of Industry, Knowledge Economy and Foreign Trade Management, Ariel Esteban Schale, are effective immediately.
