The Ministry of Production and Labor appointed Luis Enrique Green, domiciled in the Autonomous City of Buenos Aires, as the normalizing delegate of the union association United Argentine Port Workers – Port of Bajo Paraná and Delta del Paraná. The measure was made official this Tuesday (23.4.2019) in the Official Gazette, through the 255 / 2019 resolution.
In this way, the intervenor will have administrative and executive powers over the governing bodies of the entity.In exercising said powers, he/she must submit a detailed report on the financial and economic status of the entity, as well as a detailed account of his/her management in office, within 45 days from the notification of this document, to the National Directorate of Trade Union Associations dependent on the Secretariat of Labor.
Likewise, within 150 days from the notification of this measure, the institutional situation of the union must be regularized., carrying out all acts leading to the holding of general elections for the appointment of authorities.
Thus, according to the current regulations, the then Ministry of Labor and Social Security was established as the implementing authority, establishing among its powers the appointment of an official to do whatever is necessary or to regularize the situation, in the event of a state of headlessness in relation to the board of directors of a workers' union association or the body assigned the functions of a management body, and as long as the statutes of the association have not provided for the way to regularize the situation.
The union made a presentation in which it communicated about the election carried out on November 9, 2013. However, the National Directorate of Associations pointed out that although the union entity has carried out two electoral processes since 2013, its candidates have not been registered. by this authority nor recognized as elected authorities of the board of directors.
In this context, a state of headlessness was declared in relation to the authorities in charge, so from the portfolio headed by Dante Sica, they decided to appoint Luis Enrique Green as the institution's intervenor.
