The Government created the federal committee to combat smuggling and counterfeiting of brands and designations, through the Joint resolution 9/2019 of the National Institute of Industrial Property, the Ministry of Justice and the Ministry of Security.
The measure, published this Wednesday (04.12.2019) in the Official Gazette, has the purpose of carrying out the dealing with political, technical and operational issues relating to the fight against smuggling, complex crimes and associated illicit activities.
The official text states that the committee will be made up of a main representative and a substitute from the Ministry of Security, Ministry of Justice, National Institute of Industrial Property, Gendarmerie, Prefecture, Airport Security Police and Federal Police.
The initiative will fulfill certain functions such as establishing appropriate procedures to make the prevention and fight against illegal trade, manufacturing, trade and cross-border transit of pirated goods even more effective; promoting awareness campaigns among the population about the harmful effects caused by the consumption of these products; proposing training programs, as well as the establishment of standards and the participation of other organizations.
"The fight against smuggling, complex crimes and associated illicit activities is one of the central priority axes of the National Government, which provides for the commitment to create cooperation bodies that allow for the integration of different State agencies to develop joint strategies aimed at eradicating these crimes," the resolution explains.
The text also states that trademark counterfeiting and merchandise smuggling, as provided for in the Customs Code, must be understood as a phenomenon that degrades society and the quality of life of the population, "causing economic damage to industries and businesses that carry out their activities legally, negatively affecting tax collection, generating unemployment and, in certain cases, increasing risks to public health and safety."
