Customs control frameworks established for imported goods free of PCBs

The national government established to expand the customs control procedure regarding imported goods that must be free of "polychlorinated biphenyls (PCBS)", according to the  Joint General Resolution 4443/2019  

In the regulations published in the Official Gazette this Tuesday (26.3.2019), the The Federal Public Revenue Administration and the Secretariat of Environment and Sustainable Development establish, for the import destinations of the tariff items listed in Annex I, the obligation for the declarant to select in the Malvina Computer System (SIM) one of the following options::

"a) The merchandise is free of polychlorinated biphenyls (PCBs) in accordance with Article 3 of Law No. 25.670.

b) The merchandise contains polychlorinated biphenyls (PCBs) in concentrations greater than 50 ppm, in accordance with Law No. 25.670.

c) The merchandise is exempt from the prohibition of importing polychlorinated biphenyls (PCB) because it is included in Section 3 of Article 4 of Annex I of Decree 853 dated July 4, 2007.

If you choose section b), the MALVINA Computer System (SIM) will prevent the continuation of the procedure. In the event that the declarant chooses section c), he/she must have the corresponding authorization issued by the Application Authority.

The text of the regulation states that the AFIP will report such data to the Environment portfolio on a quarterly basis through electronic communication.

The resolution is signed by the Federal Administrator, Leandro Germán Cuccioli and the head of Environment and Sustainable Development, Sergio Alejandro Bergman.
