The Brazilian Government has certified nine locations as stops and rest points for drivers of cargo and passenger transport on Brazilian routes, through the Ordinance 1.640/2020.
The decision of the Ministry of Infrastructure, published this Thursday (06.08.2020) in the Federal Official Gazette, certifies establishments that have fully complied with the minimum health and safety requirements and conditions established by the normative acts of the Ministries of Infrastructure and Economy. The certification is valid for four years and can be renewed successively.
The provisions were also provisionally certified, which, at the time of inspection, were not adequate for the availability of hot water in the shower, soap and towel holder and indicative signs. In this case, the certification is valid for one year and cannot be extended.
In February this year, the government defined the acts to be adopted by companies for the recognition and certification of waiting and rest points. Application forms are available on the website website from the Ministry of Infrastructure.
In March, the government had already certified 12 waiting and rest points. All of them, including those certified on Thursday, are service stations and are located in the states of Bahia, Goiás, Maranhão, Minas Gerais, Paraná, Pernambuco, Piauí, Rio de Janeiro, Rio Grande do Sul and Sergipe.
According to the law dealing with the profession of driver (Law No. 13.103/2015), the driver is obliged, within 24 hours, to have at least 11 hours of rest, which can be divided. However, the first period must be at least eight hours of uninterrupted rest.
Professional drivers are prohibited from driving vehicles for the collective transport of passengers or the transport of goods by road for more than five and a half hours without interruption.
